Welcome to ElfTexts.com (“ElfTexts,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and holiday SMS/MMS messaging service. By creating an account or using ElfTexts, you agree to these Terms.
1. The Service
ElfTexts lets parents and guardians create child profiles and receive personalized Christmas-themed SMS/MMS messages (for example, messages presented as coming from Santa’s elves) at phone numbers you provide. Message content, schedule, and availability may change. The service may be unavailable during periods when messaging campaigns are pending provider approval or for maintenance.
2. Eligibility and Parental Responsibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You represent that you are the parent or legal guardian of each child for whom you create a profile, or that you have full authority to provide their information and consent to messaging on that phone number.
- You are responsible for the accuracy of account and child profile information, including the phone number used for MMS.
- You are responsible for activity under your account and for keeping your login credentials secure.
3. Accounts
You must provide a valid email address and may be required to verify it before using certain features. You agree not to misuse the service, create accounts for unauthorized purposes, or attempt to disrupt or reverse engineer the platform. We may suspend or terminate accounts that violate these Terms or applicable law.
4. SMS/MMS Messaging Program Terms
By providing a US or Canada (+1) phone number for a child and giving explicit consent, you agree to the following:
- Program: ElfTexts holiday / Christmas SMS and MMS messages related to the child’s personalized elf messaging experience.
- Frequency: Message frequency varies (for example, seasonal or daily messages during the holiday period). Exact timing depends on schedules and each child’s preferred send time and timezone.
- Costs: Message and data rates may apply. ElfTexts does not charge a fee for standard program messages; your carrier’s rates still apply.
- Opt-out: Reply STOP to unsubscribe from messages to that number. You may also deactivate the child profile in your ElfTexts account.
- Help: Reply HELP for help, or email support@elftexts.com.
- Restart: After opting out, you may reply START (or re-consent and reactivate in your account) to resume messages only where prior consent is on file and permitted.
- Consent: Consent is not a condition of purchase. You may withdraw consent as described above.
- Supported numbers: The messaging program supports US and Canada (+1) numbers only.
Carriers are not liable for delayed or undelivered messages. Delivery depends on carrier networks and the messaging provider.
5. Acceptable Use
You agree not to:
- Provide a phone number you are not authorized to use for this purpose.
- Use the service for spam, harassment, unlawful content, or commercial misuse.
- Interfere with messaging infrastructure, opt-out mechanisms, or other users.
- Upload or submit content that is illegal, abusive, or infringes others’ rights.
6. Content and Personalization
Messages are fictional, entertainment-oriented holiday content. Personalization uses information you enter. You are responsible for ensuring personalization details are appropriate for the child. We do not guarantee that every scheduled message will be sent or received (for example, due to inactive profiles, opt-outs, carrier filtering, or technical issues).
7. Optional Donations
If ElfTexts offers optional donations via third-party payment processors, those payments are handled by the third party under their terms. Donations are voluntary and not required to use the messaging program.
8. Intellectual Property
ElfTexts branding, site design, message templates, and related materials are owned by ElfTexts or its licensors. You may not copy, redistribute, or exploit them except as allowed through normal use of the service.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT MESSAGES WILL ALWAYS BE DELIVERED ON TIME.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELFTEXTS AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ELFTEXTS IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY) OR (B) ONE HUNDRED US DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless ElfTexts and its operators from claims arising out of your misuse of the service, your breach of these Terms, or your provision of phone numbers or child information without proper authority or consent.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.
13. Changes and Termination
We may modify these Terms by posting an updated version on this page. Continued use after changes constitutes acceptance. We may modify, suspend, or discontinue the service at any time. You may stop using the service and delete child profiles or request account closure by contacting support.
14. Governing Law
These Terms are governed by the laws of the United States and the state in which the ElfTexts operators principally reside, without regard to conflict-of-law principles, unless applicable consumer protection law requires otherwise.
