ElfTexts.com (“ElfTexts,” “we,” “us,” or “our”) provides personalized holiday SMS/MMS messages for children. This Privacy Policy explains how we collect, use, share, and protect information when you use our website and messaging service.

1. Information We Collect

We may collect:

  • Account information: name, email address, password, optional parent phone number, and timezone.
  • Child profile information: child’s name, age, MMS phone number, parent name for messages, timezone, preferred send time, and personalization details you provide (such as favorite color, good behaviour, kind act, city, state, and gift wish).
  • Messaging consent records: when you consent to SMS/MMS for a child (timestamp and IP address).
  • Message and delivery data: scheduled and sent message content metadata, delivery status identifiers from our messaging provider, and timestamps.
  • Inbound message data: texts sent to our number (such as STOP, START, or HELP), including phone number, message body, and provider message IDs, for compliance and support.
  • Technical data: IP address, browser type, and basic server logs needed to operate and secure the service.

2. How We Use Information

  • Create and manage your account and child profiles.
  • Send personalized SMS/MMS messages you have consented to receive for a child.
  • Honor opt-out (STOP), opt-in restart (START, when prior consent exists), and HELP requests.
  • Personalize message content using the details you provide.
  • Provide customer support and respond to inquiries.
  • Maintain security, prevent abuse, and meet legal and carrier messaging compliance requirements.
  • Improve and operate ElfTexts.

3. SMS/MMS Messaging

When you add a child’s phone number and provide consent, you authorize ElfTexts to send recurring automated SMS/MMS messages related to our holiday messaging program to that number. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to a message, or by deactivating the child profile in your account. Reply HELP for help, or email support@elftexts.com. Consent is not a condition of purchasing any goods or services. We do not sell phone numbers or use them for unrelated marketing.

4. How We Share Information

We share information only as needed to operate the service:

  • Messaging providers: We use a third-party messaging provider (currently Twilio) to deliver SMS/MMS and process inbound keywords. They process phone numbers and message content as our service provider.
  • Hosting and infrastructure: Service providers that host our application and database.
  • Legal requirements: When required by law, regulation, legal process, or to protect rights, safety, and security.

We do not sell personal information. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

5. Children’s Privacy

ElfTexts is intended for use by parents or legal guardians. Child profile information is provided by the parent/guardian to personalize messages. We do not knowingly collect personal information directly from children under 13 online without parental involvement. 6. Data Retention

We retain account, child profile, consent, and message records for as long as your account is active or as needed to provide the service, comply with legal obligations, resolve disputes, and enforce our agreements. Inbound opt-out and keyword logs may be retained for compliance. You may request deletion of your account and associated child profiles by contacting support; some records may be retained where legally required.

7. Security

We use reasonable administrative, technical, and organizational measures to protect personal information. No method of transmission or storage is completely secure. Please use a strong password and keep your login credentials confidential.

8. Your Choices

  • Update or delete child profiles in your account.
  • Deactivate a child to stop scheduled messages from ElfTexts.
  • Reply STOP to opt out of SMS/MMS to that phone number.
  • Request access, correction, or deletion by emailing support@elftexts.com.

9. International Users

ElfTexts currently supports US and Canada (+1) phone numbers for messaging. If you access the service from elsewhere, your information may be processed in the United States or other locations where we or our providers operate.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use of the service after changes means you accept the updated policy.
